Update: U.S. District Court Enjoins Department Of Labor's Persuader Rule Temporarily
As previously discussed in The Fast Laner, the United States Department of Labor (DOL) had implemented a new "Persuader Rule," which would significantly change the nature of the individuals and entities who are required to report as to whether they provided assistance to employers with respect to matters involving union representation and union avoidance activities. On June 27, the United States District Court for the Northern District of Texas issued a nationwide injunction against the July 1, 2016 implementation of the DOL's Persuader Rule pending a final resolution on the merits. As a result, labor and employment lawyers and labor consultants will continue to be able to provide advice and counsel to employers regarding union organizing and related activities consistent with previous interpretations of the law, pending further judicial action.
