Nationwide Preliminary Injunction Issued Against Enforcement of Corporate Transparency Act

On Tuesday, December 3, 2024, a nationwide preliminary injunction was issued by the U.S. District Court for the Eastern District of Texas in the case of Texas Top Cop Shop, Inc. et. al. vs. Garland, temporarily blocking the enforcement of the Corporate Transparency Act (CTA) and the compliance deadline of January 1, 2025. As such, neither the CTA nor the Business Owner Information (BOI) Reporting deadline can be enforced pending further order of the court.

As this injunction is preliminary and not permanent, there was no finding by the Court that the CTA and its BOI Reporting Rule are contrary to the law or that they are violative of the Constitution. As such, if this ruling changes, you may still need to file your BOI report. We will continue to keep you updated on presently pending cases that could change or modify this injunction.
